Terms & Conditions for Motorbike Tours

BACK UP – Vehicles , Tools & Spare parts: To make your ride smooth, we will provide a backup vehicle, mechanic, tool kit and some spares, which are generally needed, for motorbike journeys. Money for any of these spares or parts if used will be deducted at the end of your trip.

DAMAGE RESPONSIBILITY: Internal damages if any would be born by us i.e. if you have a problem with the engine, cylinder head or gearbox and if you are in the radius of 20 kms from Manali ,we will try to provide you with replacement bike. The cost of transportation for replacing the bike will be charged to you on actual cost basis. If you are out of reach then you will have to get the repair done from a skilled mechanic, have an estimate and inform us. Once we agree on the expenses you can go ahead with the repair job and we then reimburse you the money on your return. However, repair and maintenance such as broken control cables, burnt out bulbs and electrical parts, oil seals, topping up engine oil, flat tires, burnt clutch plates will be borne by you. You will be also liable for any external damages like broken indicators, damaged wheel rims, bent front forks, any major dents caused due to some fall etc. the expenses of these will be taken on actual cost basis. However Small dents, scratches to the body parts will be tolerable and wouldn’t be charged.

INSURANCE: Our bikes are all comprehensively insured, we will make an agreement between us this contract is not to be shown to anybody else. It is very important for you to carry your national / international driving license , as without this we will not be able to provide any services. While riding if you have an accident and if it causes serious injuries to the third party, you first priority should be to the settle the matter by paying compensation in cash rupees, if this does not materialize then it becomes a police case, where you are taken in custody and the motorcycle is impounded. In this case you will have to produce to the police the original registration book of the bike, original insurance and your international driving license. All this paper work will help us to deal with third party liabilities, which will be then involve the insurance company with whom the bike has been insured with. After receiving the necessary information from you, we will send our shop representative to the concerned place where he will engage lawyer, complete the formalities with the police and try his best to get you out of the custody. All these expenses incurred in following this procedure will have to be borne by you If the third party is not so seriously injured then it will be better to compensate at the spot without involving the police and the court. For any slight injury the compensation can be Rs.5000 to 10000 For any broken bones compensation can be Rs 50000 to 75000. It may vary from situation to situation.
In case of mishappening where a bike is badly damaged or stolen you will have to immediately inform us and we will let you know the best possible way to deal with the matter in which we will try to involve the insurance company for compensation.
In the event if the bike gets stolen or damaged, will then be charged to you on actual cost basis. We will then file the case with insurance company for compensation, which may easily take 3-6 months to materialize, and once this has been done we will reimburse the same to you in your country.

LAW & JURISDICTION : The Contract shall be construed in accordance with the Indian Law and the parties irrevocably submit to the exclusive jurisdiction of the Indian Court; Manali /Kullu, District Kullu, H.P. to settle any disputes, which may arise out of or in connection with this Contract.

LIABILITY FORM

• I understand that in order to participate on Manali Live Adventure tours, I must hold a valid Motorcycle License. lf this is not the case, I understand I will not be able to ride a motorcycle on this tour run by Manali Live.
• I understand that itineraries are subject to change due to the extreme weather conditions found in this region. I understand that if I have an accident or illness, due to the nature of the event, I may be many miles from medical facilities.
• I understand that I will ride responsibly at all times, and that I, and only I, am responsible for my safety. I will always wear appropriate gear while riding a motorcycle.
• I understand that riding in India is unpredictable. I will listen carefully to any advice that I am given by members of your team. If at any time I feel that I have not been given ample opportunity to question the team members about the riding conditions, I will say so. I acknowledge that there are risks involved while participating in this tour. I do hereby release Manali Live Holidays & Adventures and all members of the team from any and all liability arising from death, illness, injury, delay, loss or damage, cancellation of the event for any reason outside their control and from any or all claims, demands or expenses as a result of my participation on this tour. The assumption of risk is binding upon heirs, legal representatives, ensigns and myself.
• I understand that while I am on the tour, I am an ambassador for Manali Live Holidays & Adventure and I will therefore act accordingly.
• I understand that Manali Live Holidays & Adventures, subject to providing me with a full explanation, reserves the right to refuse my participation in the tour at any time. It is a fundamental condition that you acknowledge that this is an adventure tour. This requires some flexibility. The day to day itinerary is taken as a guideline only. We cannot be held responsible for any delays caused by International or domestic flights, Strikes, Government regulations, weather or natural casualties. In such cases, Manali Live Holidays & Adventures shall be responsible for suitable alternatives which could be decided upon mutual agreement. If an agreement cannot be made, Manali Live shall be responsible for refund after deducting expenses already incurred.
